Liability Waiver: You participate at your own risk. This release and indemnity agreement is made by the undersigned adult (“participant”) to release and indemnify Threshold Arts, a Minnesota limited liability company, and all of its respective members, employees, heirs, successors, agents, partners, and contractors as set forth below. Participant is voluntarily participating in the activity with full knowledge, understanding, and appreciation of the risks inherent in any physical exercise and expressly assumes all risks of injury and even death that could occur by reason of Participant’s participation. Participant releases Threshold Arts from any liability and agrees not to sue Threshold Arts for any cause of action for bodily injury, property damage, or death occurring to participant as a result of participating in this exercise program. Participant acknowledges and agrees that they should consult their primary healthcare provider prior to participating in any activities with Threshold Arts or using its facilities, especially if they have had, have, or develop a serious health condition, including but not limited to a stroke, lupus, a hernia, numbness in the extremities, an orthopedic condition, a heart condition, asthma, breathing problems, faintness, dizziness, loss of balance, recent injury/surgery/concussion, or current pregnancy. Participant hereby assumes full responsibility for risks of bodily injury or death to participant due to the ordinary negligence of Threshold Arts. Participant agrees to indemnify, defend, and hold harmless at Participant’s sole cost Threshold Arts from any and all claims arising out of participant’s participation in the exercise program I, the Participant, am at least 18 years old and I have thoroughly read and voluntarily sign this release and indemnity agreement.
